Kevin T. Smith focuses his practice in real estate and business litigation, which includes eminent domain, land use and property rights disputes. He has represented clients in all facets of the eminent domain process, including pre-condemnation planning, valuation litigation, and business and residential relocation. He also has extensive experience in litigating land use issues which have included zoning appeals, regulatory takings, boundary and access disputes, commercial lease disputes, and construction and real estate development disputes. In addition, Kevin has handled a broad range of complex business disputes, including breach of contract actions, and shareholder derivative and intra-corporate shareholder litigation.
An experienced trial lawyer, Kevin has tried more than 65 civil cases to judgment before courts and juries throughout the Commonwealth of Massachusetts, the State of Maryland, the District of Columbia and the Commonwealth of Virginia, as well as before arbitration panels and administrative agencies.
The leading independent attorney rating entity, Martindale-Hubbell, has awarded Kevin the rating of "AV", the highest rating available. The rating is made up of two components: the rating for legal ability (professional qualification), and the rating for general ethical standards. An AV rating is "a testament to the fact that a lawyer's peers rank him or her at the highest level of professional excellence."
Kevin was a faculty member at Boston University Law School where he taught legal research, writing and advocacy to first year students. He continues to be a guest lecturer there, as well as to various trade organizations in the fields of urban renewal and revitalization and the power of eminent domain.
Kevin was born in Newton, Massachusetts and grew up in Acton. He received his undergraduate degree from Boston College and his law degree from the Catholic University of America School of Law. He lives in Carlisle with his wife and four children. When Kevin is not in his office, you can find him on a field or in a gymnasium coaching youth football, basketball or whatever other sport may be in season.
